{"id":3837,"date":"2014-05-28T12:29:00","date_gmt":"2014-05-28T12:29:00","guid":{"rendered":"https:\/\/www.hardcore-hodgkin.138-201-31-57.plesk.page\/?p=3837"},"modified":"2024-08-01T12:35:27","modified_gmt":"2024-08-01T12:35:27","slug":"357-deltio-typou-28-5-2014","status":"publish","type":"post","link":"https:\/\/gcr.gr\/en\/cases-decisions-before-greek-courts\/item\/357-deltio-typou-28-5-2014\/","title":{"rendered":"Indefinite administrative detention is unlawful"},"content":{"rendered":"<p><strong>Indefinite administrative detention is unlawful, rules the Administrative Court of First instance\nIndefinite administrative detention is unlawful, rules the Administrative Court of First instance<\/strong><\/p>\n\n\n\n<p>Following an application lodged and supported by the Legal Unit of the Greek Council for Refugees (GCR), concerning the prolongation of detention for an indefinite period of an Afghan citizen, after he had already been detained for 18 months, under the pretext of \u201can obligation to stay in a detention center\u201d, the Athens Administrative Court of First Instance, ruled that the indefinite detention of migrants does not comply with the relevant legislation.<\/p>\n\n\n\n<p><strong>The above judgement&nbsp;<\/strong><strong>confirms the severe criticism previously expressed by GCR, as well as other national, European and International Organisations regarding the Opinion 44\/2014 of the Legal Council of the State, aproved by the Minister of Public Order and Citizen Protection. We underlined at that time that  the practice of indefinite detention of third country nationals is in direct violation of national, European and International Law and leads the Administration to unlawful, and thus accountable practices.<\/strong><\/p>\n\n\n\n<p>In particular, according to Court\u2019s decision, \u201c<strong><em>the restrictive measure imposed on the defendant\n\u2013i.e. the obligation to stay in a detention center-\neffectively is in fact tantamount to the extension of his detention<\/em><\/strong>\u00bb, \u03b7 \u03ba\u03c1\u03ac\u03c4\u03b7\u03c3\u03b7
